Terms of Service

Age Requirement: You must be at least 18 years of age to create an account and use Èsì. By registering, you represent and warrant that you are 18 years of age or older. Èsì is not intended for use by anyone under 18, and we do not knowingly collect information from or permit accounts belonging to individuals under 18.

Account Accuracy: You agree to provide accurate, current, and complete information during registration (such as name and email address) and to update such information to keep it accurate.

Account Security: You are responsible for maintaining the confidentiality of your account credentials (including OTP codes and passwords) and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

GPS Functionality: Èsì provides venue discovery, check-ins, local spot reviews, and community features that rely on real-time location data from your device.

Accuracy Disclaimer: Location data provided by the Service is for informational and community discovery purposes only. We do not guarantee the precise accuracy of GPS coordinates, venue hours, pricing, or availability.

User-Generated Content (UGC): You retain ownership of all reviews, photos, comments, ratings, and other content you post on Èsì.

License to Èsì: By posting User Content, you grant Èsì a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to use, host, store, reproduce, modify, publish, display, and distribute such content in connection with operating, promoting, and improving the Service.

Content Standards: You agree that your User Content will not:

• Be false, misleading, or fraudulent.
• Contain defamatory, obscene, hateful, violent, or discriminatory material.
• Infringe upon any third party's copyright, trademark, privacy, or proprietary rights.
• Contain commercial advertising, spam, or promotional links without explicit authorization.

Èsì Property: The Service, including its design, branding, software code, logos, UI/UX, and algorithms, is protected by copyright, trademark, and intellectual property laws. You may not copy, reverse engineer, decompile, or modify any part of the Service.

Trademarks: The Èsì name, logo, and related marks are trademarks of the Company. You are granted no right or license with respect to any of these trademarks.

We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without prior notice or liability, if:

• You violate any provision of these Terms or the Community Guidelines.
• Your conduct poses a safety risk to other users or third parties.
• Required by law enforcement or legal process.

You may terminate your account at any time via the in-app settings or by submitting an account deletion request.

"AS IS" Basis: The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, express or implied.

Limitation of Liability: To the maximum extent permitted by applicable law, Èsì and its officers, directors, employees, or agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, reputation, or profit, arising out of or related to your use of the Service.

Governing Law: These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria, without regard to its conflict of law principles.

International & European Users: If you access or use the Service from the United Kingdom (UK) or the European Union (France), mandatory consumer protection regulations and statutory rights provided under local laws in your country of residence shall continue to apply to you.

Dispute Resolution: In the event of any dispute or claim arising out of or in connection with these Terms, the parties shall first attempt to resolve the matter through good-faith informal negotiations. If unresolved, disputes may be submitted to binding arbitration or competent courts in the jurisdiction of your primary residence, as required by applicable local consumer law.

International Data Transfers & GDPR Compliance (UK & EU/France): To provide our Service, your personal information may be transferred to, stored, and processed in servers located outside your home country (including Nigeria and the cloud infrastructure provided by our backend partners, Supabase and SendGrid). We ensure appropriate technical safeguards and data transfer agreements are in place to protect your information.

If you are residing in the UK or France, you have specific rights under the UK GDPR and General Data Protection Regulation (GDPR), including the right to request access, correction, or erasure of your personal data; the right to restrict or object to certain data processing activities; the right to data portability; and the right to lodge a complaint with your local Data Protection Authority.

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last Updated" date or sending an email notification. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
